定义

依法行政是各级人民政府严格依照法律的规定推行公共行政并采取有效措施保证法律实施的活动。依法行政中的“行政”是指国家行政机关所从事的对公共事务的管理活动，因此依法行政是指行政机关在从事公共事务的管理活动过程中，必须遵守法律，符合法律规定，完全按照法律的要求去做，只有这样，才能达到依法行政的标准。“依法行政的根本含义是要用法来管理社会，而不是用法统治行政相对人，行政相对人与行政机关处于同一管理规范之下，任何组织和个人都没有超越宪法和法律的特权。”（韩宜甜，2011: 27）行政在日常生活中一般指“执行事务”、“政务的组织和管理等”。依法行政即政府守法，它具有如下特征：（1）在法律面前，政府没有任何特权，政府必须立于法律之下，它们只是法律所体现和表达的国家意志的执行者，它们所拥有的行政职能是国家意志的延伸。行使权力，是管理国家行政事务的需要，除去该种权力之外，它与公民和其他当事人一样，在法律面前一律平等；（2）政府行为的内容不得与国家法律相抵触。政府在其活动中有自由裁量的权力，然而，自由裁量并非漫无节制政府行为的内容必须遵守法律的原则，而不得以游离或独立于法律内容之外的所谓自我意识而为所欲为；（3）政府不仅是行政权力的行使者，而且是义务的承担者。相对权力而言，强调政府的义务性规范更具有实际意义。
