定义

邪教，是指打着宗教、气功或者其他名义的幌子，将首要分子神化，通过利用制造、散布歪理邪说等手段蛊惑、蒙骗他人，发展、控制成员，进行非法的和犯罪的教派活动组织，从本质上说任何邪教都是反社会的。根据邪教的部分外在特征可以分为以下几种：第一种，以宗教面目出现，以救世济人相标榜的邪教组织；第二种，以神秘主义面目出现，以神异能力、超能力相标榜的邪教组织；第三种，以科学面目出现，标榜开发人的潜能或治疗人类身心痼疾的邪教组织；第四种，以科学幻想小说面目出现，标榜外层空间是人类天堂的邪教组织等（孔祥涛，2001：6～8）。一个团体是否为邪教组织可以看其是否同时具备以下条件：第一，利用宗教性或哲学性邪说；第二，结成较为固定的组织；第三，有危害人权、破坏社会秩序的行为。第一个和第二个要素构成了“邪教”概念中的“教”的部分，第三个要素构成了“邪教”概念中的“邪”的部分。如果仅仅是单独一个人宣传某种邪说，没有形成什么组织，同时也没有造成社会危害，不能说它是邪教；如果一个团体仅仅在信仰上有所偏差，不同于正统宗教或者是主流意识形态与价值观，那么也只能算是异端，而不是邪教；如果一个团体侵犯人权扰乱社会秩序，但并没有利用类似宗教性质或哲学性的邪说，也不是邪教。当同时具备上面三个条件，才可以说是邪教。
