定义

中国共产党在历史新时期领导人民治理国家的基本方略，建设中国特色社会主义的重要目标之一，与以德治国相辅相成。邓小平在总结“文化大革命”的教训时，首先强调了社会主义法制建设的重要性。他在1978年指出：“必须使民主制度化、法律化，使这种制度和法律不因领导人的改变而改变，不因领导人的看法和注意力的改变而改变。”(邓小平，1994：146) 为此，就要切实做到有法可依，有法必依，执法必严，违法必究。以江泽民为核心的中共第三代领导集体高举邓小平理论旗帜，并在实践中加以发展，明确将依法治国作为党和政府管理国家和社会事务的重要方略。党的十五大明确指出：“依法治国，就是广大人民群众在党的领导下，依照宪法和法律规定，通过各种途径和形式管理国家事务，管理经济文化事业，管理社会事务，保证国家各项工作都依法进行，逐步实现社会主义民主的制度化、法律化，使这种制度和法律不因领导人的改变而改变，不因领导人看法和注意力的改变而改变。”（谢海风，2011: 56）实行依法治国的主要内容，就是使国家各项工作逐步走上法制化的轨道，实现国家政治生活、经济生活、社会生活的法制化和规范化；就是广大人民群众在党的领导下，依照宪法和法律的规定，通过各种途径和形式参与管理国家、管理经济文化事业、管理社会事务；就是逐步实现社会主义民主的制度化、法律化。实行依法治国，建设社会主义法治国家，是发展社会主义市场经济的客观需要，是社会文明进步的重要标志，是国家长治久安的重要保障。
