定义

社会主义法制是以社会主义民主为基础，通过完善立法，严格执法，确保守法建立起来的，体现工人阶级领导下的全体人民整体意志的法律制度的总和。邓小平指出：必须使民主制度化、法律化，使这种制度和法律不因领导人的改变而改变，不因领导人的看法和注意力的改变而改变”（邓小平，1994：146）。在我国，社会主义法制的基本要求是：有法可依、有法必依、执法必严、违法必究。有法可依，是社全主义法制赖以建立的基础；有法必依，是健全法制的必要条件；执法必严，是保证法制权威的根本原则；违法必究，是破坏法制应负的法律责任。社会主义法制是建立在生产资料社会主义公有制基础之上的法律上层建筑，它是为社会主义公有制经济基础服务的。由于社会主义公有制不可能在旧社会内部自发形成，因此，它必须依赖无产阶级的政权和法律而得以形成，社会主义法制是社会主义公有制经济存在和发展的必然要求。社会主义法制是工人阶级领导的广大人民意志的体现，是人民民主专政的重要工具。社会主义法制是以保障社会主义民主为根本目的的法律制度。邓小平层指出：“民主和法制，这两个方面都应该加强，这好像两只手，任何一只手削弱都不行”（邓小平，1994：154）。陈光中认为，社会主义法制与社会主义民主的关系主要表现在两个方面：“一是社会主义民主是社会主义法治的政治基础和前提，二是社会主义法制是社会主义民主的体现和保障”（陈光中，2013：17）。不要社会主义民主的法制，绝不是社会主义法制，不要社会主义法制的民主，绝不是社会主义民主。社会主义法制是以保障社会主义民主为根本目的的完备的、权威的法律制度。
