定义

发展权是个体和集体基于持续而全面的发展需要而获取的发展机会均等和发展利益共享的权利。是生存权的延伸，是个人权利和集体权利的综合，是每个人及其集合体有资格自由地向国内和国际社会主张参与、促进和享受经济、社会、文化和政治各方面全面发展的一项基本人权。从主体上看，既包括个人主体，也包括由个人所组成的集体，主要是民族和国家。作为个人权利，发展权是指《世界人权宣言》确认的各种权利的总和，即每个人都有权参与、促进并享受经济、政治、文化和社会发展。作为集体发展权，则是指各国特别是发展中国家在经济、政治、文化、社会等方面获得进步与发展的权利。发展权是发展中国家在发展问题上提出的新的法律概念，是新旧国际经济秩序斗争的产物。1969年阿尔及利亚正义与和平委员会发表了一份《不发达国家发展权利》的报告，首次提出“发展权”的概念。此后，这一概念引起国际社会的重视。1986年联合国通过《发展权利宣言》，全面阐述了发展权的基本内容。发展权的确立，对于打破旧的国际经济关系，建立国际经济新秩序，让每个国家都能获得平等发展的机会，从而解决发展中国家的发展问题，具有重要的意义(发展权.via: http://cpc.people.com.cn/GB/134999/135000/8105683.html)。
