定义

联邦指由若干成员组成的联合国家，亦称联盟国家，是复合国体的一种。联邦实行中央与地方分权制的政府形式，联邦不同于邦联，也不是单一国。在这种政府形式下，联邦有统一的宪法或法律，有自己的最高立法机关、司法机关、行政机关，是国际行为的主体。各构成单位（州、邦或共和国）也都有各自的法律制度和政府组织系统，即除了联邦有统一的宪法和政府机构外，各州（或邦或共和国，下同）都有自己的宪法、法律和政府机构，并在管辖的区域内行使职权。“联邦同各成员之间有明确的职权划分，重大权力如外交、军事、缔约、币值、关税权等均属联邦政府，其他权力保留于组成联邦的各成员”（钱其琛，2005：1125）。有时成员国还可以享有某些有限的外交权。在联邦制国家中，联邦与各州的权力划分，除非通过修改宪法，不得任意变更权力的分配，各州不得退出联邦，联邦也小得改变州的疆界，除非得到该州的同意。联邦法律为国家最高法律，在联邦和各成员的两种宪法和法律发生冲突时，以联邦的宪法和法律为准，联邦的宪法和法律的地位优越于州的宪法和法律（李盛平，1989：591）。现在世界上共有二十多个联邦国家，包括美国、加拿大、澳大利亚、瑞士、巴西、俄罗斯、印度等。联邦人民拥有一个共同的国籍。
