定义

权利公平是社会公平和正义的内在要求，是实现社会公平保障的逻辑起点和实践起点。权利公平体现在各社会成员具有平等的生存权和发展权上，并通过法律、制度以及社会运行机制等方面的安排及调整来予以实现（陈家付，2009：105）。就其主体来说，它要求所有公民都要按照宪法和法律的规定平等地行使权利和履行义务，任何公民不能被排 除在法律所赋予的权利之外；就其内容来说，权利公平不承认凌驾于法律之上或超然于法律之外的任何特权，一切权利主体享有相同或相等的权利；就其实现过程来说，权利公平既要维护所有公民的合法权利，又要保障所有公民不会受到歧视，法律能够无差别地给予救济与保障。实现权利公平的途径主要是充分保障每个公民的知情权、参与权、选择权和监督权。其次要保证立法权的公平，消除部门利益立法和背离公共意志的立法倾向。再次，要保证司法过程的公平，做到有法必依，执法必严，违法必究，维护司法公正。我国在保证权利公平方面废除了基于性别、身份、出身、 地位、职业、财产、民族等各种附加条件的限制，体现的是社会对所有成员的“不偏袒性”和“非歧视性”，体现的是社会对所有成员提供均等的政治、经济、文化等方面的发展机会，保证所有成员在平等的起点上融入社会（奚洁人，2007：135）。党的十八大明确提出，“公平正义是中国特色社会主义的内在要求；要在全体人民共同奋斗、经济社会发展的基础上，加紧建设对保障社会公平正义具有重大作用的制度，逐步建立以权利公平、机会公平、规则公平为主要内容的社会公平保障体系，努力营造公平的社会环境，保证人民平等参与、平等发展权利”（习近平，2014：95-96）。没有权利公平，机会公平、规则公平、分配公平等就无从谈起。
