定义

产权是经济所有制关系的法律表现形式。它包括财产的所有权、占有权、支配权、使用权、收益权和处置权。在市场经济条件下，产权的属性主要表现在三个方面：产权具有经济实体性、产权具有可分离性、产权流动具有独立性。产权的功能包括：激励功能、约束功能、资源配置功能、协调功能。以法权形式体现所有制关系的科学合理的产权制度，是用来巩固和规范商品经济中财产关系，约束人的经济行为，维护商品经济秩序，保证商品经济顺利运行的法权工具。在经济正义日益成为社会正义主题时，作为社会经济生活中的一项基本权利安排和制度设计，产权对维护人的生存要求无疑是基础性的。对产权内含人的基本权利要求的伦理价值观，中外思想家有较深入的论述，虽有殊异，但都认识到合乎正义的产权安排对社会公正和社会稳定发展的必要性（段建斌，2007：1）。
