定义

为了保护知识产权，我国在2008年颁布了《国家知识产权战略纲要的通知》，随后陆续出台了《商标法》、《专利法》、《技术合同法》、《著作权法》和《反不正当竞争法》等法律法规文件。当前，对知识产权的保护主要有以下几个特征：（1）保护的是一种特殊的财产权利。知识产权保护的对象不是物质载体而是精神成果本身。这是因为知识产权是人们的智力劳动创造的成果所应享有的权利在法律上的确认，智力劳动的成果是无形的精神成果，智力劳动成果要借助于物质载体存在。（2）作为知识产权保护对象的精神成果必须具有创造性，是前所未有的、首次制作的。专有性是指知识产权的权利人对自己创造的智力成果享有独占权，可以依法使用而获得利益，可以依法转让他人使用而收取报酬。未经权利人允许，任何人不得使用其智力成果谋取经济利益。（3）知识产权受到保护的时间由各国的法律规定。著作权期限较长（一般为作者有生之年再加50年），商标权的期限可在有效期内续展。中国的知识产权保护特别是专利制度在改革开放中不断发展，取得了一定的成就：1、初步建立并不断完善了专利法律法规体系。2、知识产权工作得到了上至党中央、国务院，下至各省市党委、政府的高度重视。3、形成了包括专利管理、审查、研究、教育、执法、中介服务以及专利信息等组织机构在内的全国专利工作体系和运行机制，专利保护有力地促进了中国科学技术进步和创新，发明创造活动充满生机活力，专利申请量增长势头强劲。4、形成了司法和行政执法两条途径、协调运作的专利保护机制。5、不断开拓国际合作的新局面。中国已参加了有关专利方面的国际公约，在国际舞台上发挥了积极的作用，提高了中国在国际知识产权保护领域中的声誉（via: https://baike.baidu.com/item/%E7%9F%A5%E8%AF%86%E4%BA%A7%E6%9D%83%E4%BF%9D%E6%8A%A4/6064833?fr=aladdin）。
