定义

道德律是指人的共同本性所具有的适合一切社会和时代的道德生活的基本规律，它是支配道德行为的规则。在西方，智者安提卡、西塞罗以及托马斯·阿奎那都曾对道德律作过探讨，早期它被称为“未写出的法律”。法国启蒙思想家伏尔泰也认为，根据道德的自然律制定的道德律是像你希望别人对待你那样去对待别人。中国古代许多思想家也认为存在人类先天固有的道德律，《论语·卫灵公》:“己所不欲，勿施于人”，《孟子·告子上》:“仁义礼智非由外铄我也，我固有之也。”概括地说，道德律，实际上是一种类似于禁忌的基础生活秩序，在现代社会就是一种道德命令或原则，这种基础生活秩序往往是由道德信念、成文或不成文的规则、正式或非正式的基础制度混合构成的。一般地说，这样的基础秩序是相当稳定的，甚至常常具有超越时代的特征。它平时默默地存在，以至于人们往往忽略了它，甚至在大规模的社会变革中，政权更替了，制度变迁了，这种基础的秩序也往往依然存在（李骅，2009：11-12）。
