定义

人民代表大会制度是中华人民共和国的根本政治制度，是中国人民的伟大创造。中国共产党在领导人民群众进行革命斗争中，根据革命根据地政权建设的经验，并参照巴黎公社、苏维埃政权建设的经验，逐步形成了人民代表大会制度。1940年毛泽东在《新民主主义论》中提出：“中国现在可以采取全国人民代表大会、省人民代表大会、县人民代表大会、区人民代表大会直到乡人民代表大会的系统，并由各级人民代表大会选举政府”（毛泽东，1991：677）。这一主张在人民解放区通过召开各种人民代表会议付诸实施。1949年9月制订的中国人民政治协商会议共同纲领，确定了人民代表大会制度为中国的政体。但是建国初期实行这一制度的条件还不成熟，采取了过渡的形式，在中央由中国人民政治协商会议第一届全体会议代行全国人民代表大会的职权。在地方则普遍召开了各界人民代表会议，并逐步代行地方人民代表大会职权。1954年，在普选的基础上逐级召开了人民代表大会，制定了中华人民共和国宪法，从此我国的人民代表大会制度从上到下系统地建立起来。根据《中华共和国宪法》规定，人民代表大会制度包括以下内容：（1）全国人民代表大会和地方各级人民代表大会是国家的权力机关，由民主选举产生，对人民负责，受人民监督；（2）各级人民代表大会及其常务委员会集体行使职权，集体决定问题；（3）国家行政机关、审判机关、检察机关都有人民代表大会产生，对它负责，受它监督；（4）中央和地方的国家机构职权的划分，遵循在中央的统一领导下，充分发挥地方的主动性、积极性的原则；（5）我国是个统一的多民族国家，各少数民族聚居的地方实行区域自治，民族自治地区的自治机关，即人民代表大会和人民政府，行使宪法赋予的一般地方国家机关的职权，另一反面享有宪法和法律赋予的自治权。实践证明，人民代表大会制度是适合我国国情的，具有强大生命力的根本政治制度（刘政等，1992：14-15）。
