定义

托管权，是指把事物移动或者放置在一起之后，将所属物的某些权力交给他人代为管理，是户主将所有物委托给他人代为管理与经营，是户主由于各种原因将事物全部或部分经营事物交给托管合作社或者其他机构代为管理。例如，土地托管。“土地托管是一种新兴的农业生产经营方式，不但能够优化农村土地资源配置，实现土地的规模化经营，提高农业生产效益；而且能够促进农村劳动力转移，增加农村居民收入。土地托管，顾名思义就是农户将耕地委托他人代为管理和经营，是不愿意耕种土地或没有能力耕种土地的农民将全部或者部分经营事务交由土地托管合作社或其他机构代为管理的一种形式；它是农村基层经济组织根据其自身需要和农民实际需求创新出的一种经营方式。与传统的土地流转形式相比，它坚持农民作为耕地经营的主体地位，不改变农民土地经营权和农民作为土地投入和收益的主体地位，具有土地流转的各种优势，包括能够提高农业生产的集约化、规模化专业化水平以及提高农业生产效益等。与此同时，土地托管能够较好的克服目前土地流转中存在的农户参与不积极、流转规模小、期限较短、土地经营权不稳定以及流转权属不清等问题”（李登旺等，2013：37）。那么，要更加深入理解托管权可以结合具体领域来理解，例如，教育托管、公司托管、资金托管等等。
