法治政府就是政府在行使权力履行职责过程中坚持法治原则，严格依法行政，政府的各项权力都在法治轨道上运行。要求各级人民政府从决策到执行及监督的整个过程都纳入法制化轨道，权利与责任紧密相联，集阳光政府，有限政府，诚信政府，责任政府于一身，并用法律加以固定即为法治政府。依法治国作为中国基本治国方略，强调科学立法、严格执法、公正司法和全民守法，其中执法是关键。国家的法律法规都需要各级政府来实施，与群众关系最密切的也是各级人民政府，政府的决策与执法活动是否合法、是否适当，不仅关系人民福祉和社会稳定，也关系依法治国这一基本方略能否落实。因此，法治政府是依法治国的关键，如果能够紧紧抓住这个关键，在规范政府权力的行使、防止权力滥用方面有切实可行的制度安排，将对全面推进依法治国产生重大作用。
