定义

民主权利是指公民依法享有的各种民主和自由权利，是公民基本权利的主要部分。古希腊奴隶制时代出现的民主制，就曾规定公民的权利。18世纪法国资产阶级革命时曾发表《人和公民的权利宣言》（简称《人权宣言》）（金炳华，2003：340）。近代西方资产阶级启蒙学者以自然法理论和社会契约论为基础，将民主权利与人的生存、财产、追求幸福等权利看成是人的自然本性，是天赋的、神圣不可剥夺的。他们认为，在国家生活中应以政治民主为价值取向，而政治民主则体现为人的民主权，政府的存在和合法必须以获得公民同意为基础。“民主权利简称民权，它是人民主权的具体体现，是相对于‘公权力’而言的‘公民权利’，是一个国家的公民对于国家意志的形成和实现的‘支配权’，这种‘支配权’在我国被形象地表述为人民‘当家作主’的权力。民主权利既是国家权力产生和存在的基础和源泉，也是公民控制和对抗国家权力的主要武器”（邓成明，2005：81）。民主权利作为基本人权的重要内容，其存在形式包括应有权利、法定权利和实有权利三种。法定的民主权利是国家宪法和法律所确认和规定的民主权利。实有的民主权利是一国公民在现实政治生活中所能实际享有的民主权利（邓成明，2005：82-83）。现代国家公民应有的民主权利是基于人民主权原则而产生的。民主权利的内容包括：公民的人身安全、民主自由、管理国家、管理各项经济、文化事业的权利；对国家领导人的选举权和被选举权；对政府的监督和批评权；对国家重大事务的提出建议权；对国家公职人员揭发、检举权；对企事业和地方生活的民主管理权以及对国家机关及其工作人员的监督权等。公民在行使和享受自由、权利时，不得损害国家的、社会的、集体的利益和其他公民的合法的自由和权利。公民的权利和义务是不可分离的。
