社会主义法治国家，是党领导人民治理国家的基本方略，是一种与社会主义根本制度结合的民主政体。中共十五大报告首次明确指出，要“发展民主，健全法制，建设社会主义法治国家”，“在坚持四项基本原则的前提下，继续推进政治体制改革，进一步扩大社会主义民主，健全社会主义法制，依法治国，建设社会主义法治国家”。中共十六大报告强调，要把坚持党的领导、人民当家作主和依法治国有机统一起来。中共十七大报告进一步指出，要坚持依法治国基本方略，树立社会主义法治理念，实现国家各项工作法治化，保障公民合法权益；坚持社会主义政治制度的特点和优势，推进社会主义民主政治制度化、规范化、程序化，为党和国家长治久安提供政治和法律制度保障；要坚持科学立法、民主立法，完善中国特色社会主义法律体系，加快建设社会主义法治国家（奚洁人，2007：9）。
　社会主义法治国家的概念，兼具形式法治国和实质法治国的内涵。从形式上看，包含“社会主义”、“法治”、“国家”三个要素。“社会主义法治国家”概念统合下的规范实质，仍然体现普遍法治的基本要义，须强调法治与宪法、人权的内在关系。形式法治国注重“手段”层面，实质法治国加以价值判断。随着社会矛盾的出现与冲突的加剧，法治国家从形式主义法治国家向实质主义法治国家转变，出现了实质的法治国家形态。遵循社会主义法治国家的要求，必须把党的领导、发扬人民民主和严格依法办事三者有机结合、和谐统一起来；必须做到“有法可依，有法必依，执法必严，违法必究”（张震，2014：131）。
