宪法是一个国家的根本大法，是一个国家法治的基石，也是一个国家文化和文明的标志性载体。毋庸置疑，宪法在国家的政治、经济、文化和社会生活中发挥着极为重要的作用。党的十八届四中全会审议通过的《中共中央关于全面推进依法治国若干重大问题的决定》（以下简称“四中全会《决定》”）特别强调，坚持依法治国首先要坚持依宪治国，坚持依法执政首先要坚持依宪执政，凸显了宪法在全面推进依法治国中的地位（黄进，2014：35）。
