定义

中国特色社会主义法律体系，是指自我国改革开放以来，享有立法权和司法解释权的国家机关，坚持在中国共产党的领导下，为保障人民民主专政的国家政权及国家、集体和公民个人的合法权利而制定并修正的宪法、法律、行政法规、司法解释和地方性法规的而建立起来的法律体系的总称。中国特色社会主义法律体系，是以宪法为统帅，以法律为主干，以行政法规、地方性法规为重要组成部分，由宪法相关法、民法商法、行政法、经济法、社会法、刑法、诉讼与非诉讼程序法等多个法律部门组成的有机统一整体。依法治国，建设社会主义法治国家，是中国共产党领导人民治理国家的基本方略。形成中国特色社会主义法律体系，保证国家和社会生活各方面有法可依，是全面落实依法治国基本方略的前提和基础，是中国发展进步的制度保障。中国特色社会主义法律体系是在中国共产党领导下，适应中国特色社会主义建设事业的历史进程而逐步形成的。中国特色社会主义法律体系最早可以追溯到建国初期，中华人民共和国面临着组建和巩固新生政权、恢复和发展国民经济、实现和保障人民当家作主的艰巨任务。根据政权建设的需要，从1949年到1954年第一届全国人民代表大会召开前，中国颁布实施了具有临时宪法性质的《中国人民政治协商会议共同纲领》，制定了一系列法律、法令，开启了新中国民主法制建设的历史进程。中国特色社会主义法律体系，是新中国成立以来特别是改革开放30多年来经济社会发展实践经验制度化、法律化的集中体现，是中国特色社会主义制度的重要组成部分，具有十分鲜明的特征。第一，中国特色社会主义法律体系体现了中国特色社会主义的本质要求。第二，中国特色社会主义法律体系体现了改革开放和社会主义现代化建设的时代要求。第三，中国特色社会主义法律体系体现了结构内在统一而又多层次的国情要求。第四，中国特色社会主义法律体系体现了继承中国法制文化优秀传统和借鉴人类法制文明成果的文化要求。第五，中国特色社会主义法律体系体现了动态、开放、与时俱进的发展要求。（《中国特色社会主义法律体系》白皮书发布（全文）.via：http://www.gov.cn/jrzg/2011-10/27/content_1979498.htm）。
