定义

“共同但有区别的责任”原则一直是中国参与国际气候谈判的基础。这一原则的正式确立是在1992年6月在巴西里约热内卢召开的“联合国环境与发展大会”上，大会正式批准了《气候变化框架公约》(下称《公约》)。公约第四条正式明确提出“共同但有区别的责任”原则。
“共同但有区别的责任”发端于上世纪70年代初。1972年斯德哥尔摩人类环境会议宣示，保护环境是全人类的“共同责任”；同时指出，发展中国家的环境问题“在很大程度上是发展不足造成的”。这已是“共同但有区别的责任”的雏形。从上世纪80年代末起，“共同但有区别的责任”逐渐成为国际谈判中的一项规范用语。1992年，《公约》开放签字，《公约》第四条正式明确了“共同但有区别的责任”。1997年，《京都议定书》第十条确认了这一原则，并以法律形式予以明确、细化。它规定发达国家应承担的减少温室气体排放(“减排”)的量化义务，而没有严格规定发展中国家应当承担的义务。这是这条原则的具体体现。（共同但有区别的责任.via:http://news.cnr.cn/special/21qhdh/bk/20151124/t20151124_520582943.shtml）
“共同但有区别的责任”原则主要是出现在国际环境法中，是国际环境法的基本原则之一。其内容可被分为两个部分，即“共同责任”部分和“有区别的责任”部分，“共同责任”部分明确各国在国内、地区和全球范围内保护环境的共同责任，要求所有相关国家都参与到应对全球环境问题的措施中。“有区别的责任”部分是指要考虑每一个国家的不同情况，特别是相关国家造成某一特定问题的责任，以及其阻止、减少和控制危险的能力。考虑到发达国家和发展中国家对相关全球环境问题的不同历史原因，以及其各自的经济和技术能力的不同，此原则旨在找出一个平衡的解决方法。（李阳春，2010：2）
