定义

行政问责制，是指特定的问责主体针对各级政府及其公务员承担的职责和义务的履行情况而实施的要求其承担否定性结果的一种规范。问责对象主要是政府部门或者公务员应当履行而没有履行的职责和义务，或者没有恰当地履行义务的种种行为；问责的方式主要是公开道歉、责令书面检查，通报批评、公开谴责、诫勉，引咎辞职、撤职、免职、责令辞职，行政处分，刑事追究等；问责的范围包括政府和公务员在政治行政体系中所承担的各种责任，包括其内含的道德责任、政治责任、行政责任和法律责任。（行政问责.via:

行政问责制作为一项制度确立最早出现在近代的西方，是在反对封建社会权力与责任脱离的规则体系中建立在一系列理论基础上的。我国行政问责制的逐步确立，虽然在事例上与历史有一定的连贯性，但是其思想基础及制度安排更多受到西方行政问责制的影响。（张军辉，2006：16）在不同的历史时期，行政问责的目的和理论基础是不同的，因此也就存在本质性的区别。封建时代问责的动力来自统治者维护自身统治的需要，而现代民主政治下的行政问责制则源于责任政府的本质要求，源于人民主权、法治、积极政府以及社会契约等民主法治理念的要求。（张军辉，2006：19）
我国在行政问责制的建设方面比较薄弱，行政问责制尚未形成制度化的法规，只是散见于一些规定和条例中。改革开放后，为了使问责制真正做到制度化，在各地探索新途径的同时，中央政府也在积极加快推进问责制度化的步伐。2003年5月12日，《公共卫生突发条例》明确规定了处理突发公共卫生事件的组织领导、遵循的原则和各项制度和措施，明确了各级政府及有关部门、社会有关组织和公民在应对突发公共卫生事件中应承担的责任和义务及违法行为的法律责任。2003年8月27日通过的《行政许可法》，规定了政府的行政许可行为，也明确规定了违反本法应承担的法律责任。2004年2月18日，《党内监督条例(试行)》中有了关于“询问和质询”、“罢免或撤换”的规定；《中国共产党纪律处分条例》专门规定了对有失职、渎职行为的党员干部给予相应处分。2004年4月，《全面推进依法行政实施纲要》明确提出“权责统一”是依法行政的基本原则，对决策责任追究、行政执法责任制以及完善行政复议责任追究制度等作了明确的规定。2006年1月1日，《中华人民共和国公务员法》对公务员向上级承担责任的条件和公务员辞职辞退作了明确规定，并进一步将行政问责法制化和规范化。（行政问责.via:
