根据宪法和《全国人民代表大会议事规则》，中华人民共和国主席和副主席由全国人大选举产生。选举产生国家主席和副主席的具体程序是：首先，由全国人大主席团提出候选人名单。其次，将候选人名单送交各代表团酝酿协商。再由主席团根据多数代表的意见，确定正式候选人名单。最后，由主席团将正式候选人名单交付大会投票表决。宪法规定了国家主席和副主席候选人的法定资格。候选人的法定资格或基本条件有三方面：其一，他们必须是中国公民；其二，他们必须享有选举权和被选举权；其三，他们必须年满45周岁。国家主席是由全国人大选举产生的，并对它负责，国家主席在法律关系上从属于国家权力机关。宪法第79条第3款明确了国家主席的任期。“主席、副主席每届任期同全国人民代表大会每届任期相同，连续任职不得超过两届。”国家主席在根据全国人大及其常委会对国家重大事项作出决定后，根据宪法规定的程序和范围，行使国家主席职权，主要有以下几方面：公布法律权、发布命令权、任免权、外交权、宣战权、荣典权。当国家主席缺位时，由副主席继任主席席位；当国家主席和副主席都缺位时，应由全国人大补选，补选之前，由全国人大常委会委员长暂时代理主席职位（朱国斌，1997：163）。
