2016年11月10日，国务院办公厅印发《控制污染物排放许可制实施方案》（以下简称《实施方案》）。正确理解《实施方案》和中央精神，对于保证控制污染物排放许可制的及时有效实施，具有十分重大的意义。控制污染物排放许可制是依法规范企事业单位排污行为的基础性环境管理制度，环境保护部门通过对企事业单位发放排污许可证并依证监管实施排污许可制，对于推进环境治理体系和治理能力现代化具有十分重要的意义。排污许可证将成为企事业单位生产运行期间排污行为的唯一行政许可和接受环保部门监管的主要法律文书。《实施方案》对排污许可制的核心内容作出了明确规定，主要有以下几点。第一，制定排污许可的管理名录；第二，规范排污许可制的核发；第三，合理确定许可的内容；第四，分步实现排污许可的全覆盖；第五，严格落实企业事业单位环保责任。实施排污许可制，大大方便环保部门对企事业单位排污行为的规范和严格监管，重点聚焦企事业单位许可证执行情况，核实企事业单位排放数据和执行报告的真实性，依法惩治无证排污和不按证排污的违法行为。通过排污许可证制，在明确了企业守法要求的同时，也划定了环保部门的执法边界，这对于推动形成公平规范的执法守法秩序，将发挥重要作用（孙佑海，2016:9-11）。
