美国劳动者与资方的关系(刘伟等,1994:360)。它指雇佣劳动者与资本家之间的关系,即雇佣劳动者被剥削、资本家无偿占有雇佣劳动者所创造的剩余价值的关系(胡代光等,1996:570)。在20世纪40年代以前,工会的力量相对较弱,原因有两方面,一是资方的力量比较强大,二是政府对资方的偏护。1947年,美国制定了劳资关系法即塔夫脱——哈特利法。该法的目的是在1936年的瓦格纳法通过以后建立集体谈判过程中的新的均势。瓦格纳法是美国主要的劳资关系法,除了航空系统和铁路系统适用“铁路劳工法”外,它适用于所有州际商业,瓦格纳法保证工人在组织工会和选择集体谈判代表方面享有充分的自由权;它禁止雇主或工会采取某些不正当的劳工行动。由于瓦格纳法解除了对工会的许多限制,使它们得以在没有为资方和非工会会员提供足够的保护的情况下自由发展。政府对瓦格纳法的修订而形成1947年的塔夫脱——哈特利法。政府在劳资争议中的作用是保护公众的利益,既不袒护劳方也不袒护资方。为此,该法改组了国家劳工关系委员会,建立了联邦仲裁与调节局。该法还开列了劳方和资方所采取的可能是针对对方或针对非工会会员的种种不公平的劳工行为,对于确定工会的代表以及在集体谈判过程中的程序做了详尽而广泛的规定。该法规定,法院必须复审国家劳工关系委员会的诉讼,就劳工组织提出的诉讼或控告劳工组织的诉讼也作了规定。1959年,兰德勒姆——格里芬法即劳资管理报告和揭露法对1947年劳资关系法进行了修正(刘伟等,1994:360)。
 随着资本主义经济的发展,现阶段劳资关系的形式为,以代表雇佣劳动者的利益的工会为一方,以代表资本家利益的雇主协会为另一方,就雇员保障、工会保障、工资、工时、工作条件等有关劳动者政治权利和经济利益的问题进行谈判交涉。这种谈判地位的相对变化以及相关法律的确立并不意味着劳资关系的性质有任何改变,雇佣劳动者与资本家之间,在利益上是根本冲突的。劳资关系紧张是必然的,只有当雇佣劳动者联合起来,剥夺资本家占有的生产资料,雇佣劳动者才能获得解放,劳资关系才能结束(胡代光等,1996:570)。
