定义

契约伦理是蕴含于市场经济契约关系中的伦理要求与价值精神，它是市场经济（商品经济）发展的产物，是市场社会或契约社会人们处理社会关系或进行交往的基本准则和原则，它是以契约精神为核心扩张而成的社会性关系理念。市场经济的形成，意味着社会从身份社会（等级社会）向契约社会的转型，即从封闭型社会或小社会群转向开放型大社会，意味着社会伦理也由血缘伦理（身份伦理）转向契约伦理。从身份社会（等级社会）转向契约社会，市场社会里的市场秩序是通过普遍的、抽象的、非人格化的规则来建立和维系的，这些规则就是随着商品经济（市场经济）的发展逐步演化发展而来的，规范人们竞争、交换、贸易以及私生活的契约规则。这些规则的最大作用在于划定明确的人际界限，而这种划定是通过契约规则的制度化来完成的，诸如经济制度和法律制度。经济制度和法律制度中蕴含的经济伦理和法律伦理，更多地体现了契约伦理的色彩，象征着市场秩序的契约社会本质。因而，契约伦理必然转向制度伦理（尤春媛，2012：117-118）。作为制度伦理的契约伦理强调互惠互利，“不是道义上的恩惠，而是通过制度设计，在一定社会制度下进行的平等权利和利益的交换。一种社会利益关系如果仅仅建立在主观同情善意上，那么，这是一种偶然性的没有任何保障的社会利益关系。只有建立在一种客观制度化的社会公正上，公正的利益关系才有可能真正建立”（高兆明，2005：386）。契约伦理是一种程序伦理，它强调按彼此约定的契约程序办事处世；同时也是一种意图伦理，是当事人双方或多方意志和愿望的程序化表现。契约的订立与维护，体现了主体之间的意志自由、权利平等和义务平等。契约伦理在当代中国改革开放的浪潮中兴起，反映了中国伦理文化从注重身份到注重契约的巨大变迁（金炳华，2003：658）。
