定义

行政监察（administrative supervision）是各级政府行使监察职能的机关，指国家各级行政监察机关依法对国家行政机关及其公作人员和国家行政机关任命的其他人员执行国家法律、法规、政策和决定、命令的情况以及违法、违纪行为进行监察、纠举、惩戒等具有行政法律效力的专门活动。行政监察是我国专门监督的重要组成部分，它伴随着行政活动而产生，只要行政活动不停止，监察就一直进行下去（甄玉金等，1998，via： http://book.duxiu.com/EncyDetail.jsp?dxid=900007077592&d=20D6E4EC8AFE350D541C432D99696A7B）。国家行政监察机关的主要任务和职责是，“检查监察对象贯彻实施国家政策和法律法规的情况；监督处理监察对象违反法律和违反政纪的行为；受理个人或单位对监察对象违反法律和违反政纪行为的检举、控告；受理监察对象不服纪律处分的申诉；按照行政序列分别审议经国务院任命的人员和经地方人民政府任命的人员的纪律处分事项”（何山，1994：410）。行政监察有五个本质特征，一是专门性，行政监察有专门的机构；二是监察对象的固定性，主要为国家行政机关及其工作人员；三是强制性，行政监察会直接产生法律后果；四是监督检查的确定性，对国家行政机关及其工作人员的行政行为进行监察；五是综合性，涉及面很广（王嵩山1989：181）。行政监察的作用主要表现在：第一，行政监察使行政机关的内部法制监督活动专门化、法制化。第二，行政监察使行政管理的运行机制更加科学合理。第三，行政监察是保障人民民主权利的有力武器。第四，行政监察有助于维护和严肃政纪，克服官僚主义，提高行政效能（杨五湖等，1990，via：http://book.duxiu.com/EncyDetail.jsp?dxid=900007219763&d=A933B73789BA2AAA97669FD3736BB6A6）。
