定义

行政法规指国家行政机关依法制定和发布的规范性文件，具有法律效力，是履行行政职责的规范性文件的总称。各国宪法大多授权行政机关发布具有普遍约束力的规范性文件。中国宪法规定，国务院是最高国家行政机关，有权根据宪法和法律，制定行政法规。发布行政法规需要国务院总理签署国务院令。行政法规的具体名称很多，如条例、章程、决定、命令、通告、通知等，行政法规不得与宪法和法律相抵触，它的效力仅次于法律，但高于部门规章和地方法规。（王建民，1991：211）。行政法规的权限范围为：“为执行法律的规定需要制定行政法规的事项；宪法第八十九条规定的国务院行政管理职权的事项。应由全国人民代表大会及其常务委员会制定法律的事项，国务院根据全国人民代表大会及其常务委员会的授权决定先制定的行政法规，经过实践检验，制定法律的条件成熟时，国务院应当及时提请全国人民代表大会及其常务委员会制定法律”（崔卓兰，1992，via： http://book.duxiu.com/EncyDetail.jsp?dxid=900010978203&d=20011C51C04BE2EDA6F74B1D10D4B0B2）。国务院所属各部、委，省、市、自治区以及省、自治区所在地的市和经国务院批准的较大的市的人民政府，亦可根据国家法律和国务院的行政法规制定实施于本地区、本部门的规章，此种规章具有行政法规的性质。国务院有权改变或撤销各部、委及地方各级行政机关颁布的行政法规，县以上人民代表大会有权撤销本级人民政府及下级人民政府的不当法规、决议等。违反行政法规，要依法给予纪律处分或行政处罚，情节严重构成犯罪的，依法给予刑事处分（刘隆亨，1992：246）。
