定义

知识产权是人们在科学、技术、文化、艺术等领域，从事智力劳动创造的成果在法律上确认的产权，最早出现在第一次工业革命时期。根据中国《民法通则》的规定，知识产权属于民事权利，是基于创造性智力成果和工商业标记依法产生的权利的统称。它包括知识财产权和知识所有权，是著作权（即版权）、专利权、商标权等无形财产的专有权的统称。其中，“著作权发生在文化创作领域，与文化创新、文化产业息息相关；专利权产生于技术应用领域，与科技创新、科技产业紧密相连；商标权则运作于工商经营领域，涉及商品销售、市场贸易等诸多问题。”（吴汉东，2011：39）1967年签订的《建立世界知识产权组织公约》使知识产权成为国际通用的法律概念。根据《建立世界贸易组织协定》的解释，知识产权的范围包括：（1）版权与相关权利，（2）商标，（3）地理标志，（4）工业设计，（5）专利，（6）集成电路布图设计（拓扑图），（7）对未披露过的信息的保护，（8）对协议许可中限制竞争行为的控制。知识产权在历史上被长期称为“无形产权”。从本质上说，知识产权的确是一种无形财产权，客体是人类的智力成果或者知识产品，是一种无形财产或一种没有形体的精神财富，是创造性的智力劳动所创造的劳动成果。
