法律援助是指由政府设立的法律援助机构组织法律援助的律师，为经济困难或特殊案件的人给予无偿提供法律服务的一项法律保障制度。特殊案件是指依照《中华人民共和国刑事诉讼法》第三十四条的规定，刑事案件的被告人是盲、聋、哑或者未成年人没有委托辩护人的，或者被告人可能被判处死刑而没有委托辩护人的，应当获得法律援助。法律援助制度是人类法制文明和法律文化发展到一定阶段的必然产物，是国家经济、社会文明进步和法治观念增强的结果。用法律的手段帮助人民群众解决诉讼难的问题，是当前我国建设社会主义法治国家大背景下的必然选择，是促进司法公正的重要保障。法律援助是一项扶助贫弱、保障社会弱势群体合法权益的社会公益事业，同时也是中国实践依法治国方略，全面建设小康社会的重要举措。中共中央、国务院对法律援助工作十分重视，国家“十五”计划纲要将“建立法律援助体系”确定为“十五”社会发展目标，党的十六大明确提出“积极开展法律援助”，并作为建设社会主义政治文明的重要内容。《法律援助条例》的颁布实施和“为实现公平和正义法律援助在中国”大型公益活动的开展，标志着我国法律援助工作在广度和深度上有了新的拓展和突破（法律援助.via: http://baike.so.com/doc/5393793-5630852.html）。
