定义

即“社会公平和正义，它以人的解放、人的自由平等权利的获得为前提，是国家、社会应然的根本价值理念”（韩圣喜等，2014：131）。它是人类社会永恒的价值追求，自人类的道德现象产生之日起，就如同天上的星星一样始终指引着人类追求理想社会状态的发展之路。公正的观念在西方被认为是表明道德最原初的观念（董立平，2014：290）。公正的内容是具体、历史的，不同的时代、不同的利益集团，有不同的公正内容。在最抽象的意义上，公正可以规定为以权利与义务关系为核心的人们相互关系的合理状态。不同的时代、不同的人们，均依自身对合理的理解而赋予公正现实的内容，而只有与必然相联系的合理才有可能是真实的合理（高兆明，2001：31）。公正对于一个社会来说是至关重要的。其一，公正是现代社会的制度设计与安排的基本依据。一个社会的“正常运转”有赖于体系化的规则的存在。其二，公正对于效率的生成与促进具有举足轻重的意义。对于社会潜能的激发、人力资源的充分开发而言，公正的机会平等规则和按照贡献进行分配规则具有不可替代的作用。其三，公正是社会实现安全运行的必要条件。只有遵循公正的规则，社会的各个阶层才能实现良性的互动，才能形成有效的、持续的整合与合作（吴忠民，2004：1-2）。
